Tenant advice hits landlords

Local councils are infuriating landlords with residential lettings by advising tenants to wait to be thrown out if they fail to meet repayments.

Worse still for any buy to let landlord, advising tenants to wait until they are served an eviction notice before they move is becoming "very common practice", reports the Observer.

Under UK law, a landlord must first issue tenants that fall behind with their rent with a Section 21 notice.

Only after a period of two months following this will they be allowed to seek a court possession order and finally, following this, an eviction order at which point tenants have no choice but to leave.

Property law specialist Mark Loveday told the newspaper: "This is a very, very common practice employed by local authorities across the country.

"A Section 21 should be enough notice for most tenants to move out, but councils havethe discretion to advise them to stay longer and many are doing so."

The Citizen's Advice Bureau admitted it was concerned with the high level of missed rent and mortgage payments in recent months.
