Landlords must acquire sufficient evidence for their case if they get involved in a dispute with tenants, an expert has said.
Tom Entwistle, director of Landlordzone, an online community portal for letting, said both landlords and tenants have to provide "good evidence" of the state the property was left in when a dispute emerges.
In cases where the Deposit Protection Service settles disputes between tenants and landlords, both parties are expected to submit evidence so an objective decision can be made, Mr Entwistle advised.
"The party with the best case supported by good evidence will usually win," he said.
Mr Entwistle added that contrary to popular belief, the number of tenant deposit disputes is relatively small in proportion to the total number of UK tenancies.
The number of new tenants rose by close to 20 per cent in the three months to the end of August 2008, according to figures from the Association of Residential Letting Agents.
